1. Introduction & Acceptance
Welcome to TrainX Solutions ("TrainX", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your enrolment, participation, and use of our vocational education and training services, including qualifications, accredited short courses, high-risk work licences, and compliance consultation services.
By enrolling in any of our courses or using our services, you agree to be bound by these Terms. If you do not agree, please do not proceed with enrolment.
🛡️ Your Consumer Rights
If you are enrolling as an individual for personal or domestic purposes, you have additional rights under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL.
2. Definitions
In these Terms, the following terms have the meanings set out below:
- "Course" means any qualification, accredited short course, high-risk work licence training, or compliance consultation service offered by TrainX Solutions.
- "Student" or "You" means the individual or organisation enrolling in a Course.
- "RTO" means Registered Training Organisation, being a training provider registered by the Australian Skills Quality Authority (ASQA).
- "Training Contract" means the agreement between the Student and TrainX Solutions for the delivery of a Course.
- "Intellectual Property" includes all training materials, course manuals, assessments, trademarks, and confidential information provided by TrainX.
- "Working Day" means Monday to Friday, excluding public holidays in Queensland.
3. Enrolment & Training Contracts
Enrolment is confirmed when we send you a confirmation email indicating acceptance of your application. A binding Training Contract exists only once we have provided written confirmation to you.
- You must provide accurate and complete information during enrolment.
- We reserve the right to accept or decline any enrolment application at our discretion.
- For apprenticeship and traineeship programs, a formal Training Contract may be required, signed by you, your employer (if applicable), and TrainX Solutions.
- If you are under 18 years of age, a parent or guardian must consent to the enrolment.
4. Fees & Payments
All fees are set out on our website or in your enrolment documentation. Fees are inclusive of GST where applicable. Payment is due as follows:
- Upfront payment: Full payment is required at least 14 Working Days before the course start date, unless alternative arrangements have been agreed in writing.
- Payment plans: Where approved, payments must be made according to the agreed schedule. Failure to meet payment deadlines may result in suspension of access to the Course.
- We accept payment by credit card, debit card, bank transfer, or other methods specified at enrolment.
We reserve the right to charge interest at 1.5% per month on overdue amounts.
5. Cancellation & Refunds
5.1 Cancellation by Student
- More than 14 days before course start: Full refund, less a $50 administration fee.
- 7–14 days before course start: 50% refund of the course fee.
- Less than 7 days before course start: No refund, unless exceptional circumstances apply and are supported by documented evidence.
- After course commencement: No refund, except where required by the Australian Consumer Law.
5.2 Cancellation by TrainX Solutions
We reserve the right to cancel or postpone a Course due to insufficient enrolment, trainer unavailability, or other unforeseen circumstances. In such cases, we will offer you a full refund or the option to transfer to a future Course at no additional cost.
💡 Your Rights Under Australian Consumer Law
Nothing in this cancellation policy limits your rights under the Australian Consumer Law. For example, if a Course is not provided with due care and skill, or is not fit for purpose, you may be entitled to a remedy.
6. Student Obligations
As a Student of TrainX Solutions, you agree to:
- Attend all scheduled training sessions and complete all assessments in a timely manner.
- Act with honesty and integrity, and not engage in plagiarism, cheating, or any form of academic misconduct.
- Follow all workplace health and safety instructions provided during practical training.
- Report any injuries or incidents to your trainer or supervisor immediately.
- Use any equipment, tools, or materials provided by TrainX Solutions responsibly and in accordance with instructions.
- Respect the rights of other students and staff, and not engage in bullying, harassment, or discrimination.
7. Provider Obligations
TrainX Solutions is committed to providing high-quality vocational education. We agree to:
- Deliver courses in accordance with the Standards for Registered Training Organisations (RTOs) 2025.
- Provide clear and accessible pre-enrolment information, including course content, fees, and assessment requirements.
- Employ qualified and experienced trainers and assessors with current industry expertise.
- Provide appropriate learning resources, support services, and reasonable adjustments to accommodate students with diverse needs.
- Maintain a safe, inclusive, and harassment-free learning environment.
- Ensure your enrolment details are accurately recorded and maintained.
8. Intellectual Property
All Intellectual Property in our training materials, course content, assessments, and other resources is owned by TrainX Solutions or our licensors.
- You are granted a limited, non-exclusive, non-transferable licence to use these materials for your personal training purposes only.
- You must not reproduce, distribute, share, or resell any TrainX Solutions materials, in whole or in part, without our prior written consent.
- All trademarks, logos, and branding displayed on our website and materials remain our exclusive property.
9. Privacy & Data Protection
TrainX Solutions collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
- We collect personal information, including your name, contact details, payment information, and training records, for the purposes of enrolment, course delivery, and regulatory reporting.
- Your information may be shared with government bodies such as ASQA or the Department of Home Affairs for international students.
- We do not sell or rent your personal information to third parties for marketing purposes.
- You may request access to or correction of your personal information by contacting us.
10. Complaints & Appeals
We are committed to resolving any concerns you may have. TrainX Solutions has a formal complaints and appeals process, which is available upon request.
- Step 1: Raise your concern informally with your trainer or course coordinator.
- Step 2: If not resolved, submit a formal complaint in writing to our Complaints Officer at complaints@txs.edu.au.
- Step 3: We will acknowledge your complaint within 5 Working Days and provide a written response within 30 days.
- If you are not satisfied with our response, you may refer your complaint to the relevant external body, such as the Australian Skills Quality Authority (ASQA) or the relevant state Ombudsman.
11. Limitation of Liability
To the maximum extent permitted by law, TrainX Solutions excludes liability for any indirect, consequential, or special loss or damage arising out of or in connection with your enrolment or participation in our Courses.
Our total aggregate liability arising out of or in connection with these Terms is limited to the total amount paid by you to us for the relevant Course.
This limitation does not apply to liability that cannot be excluded or limited under the Australian Consumer Law.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts in Queensland.
